Operating and safety rules of HUDY Boulder Karlín

Purpose of the document. These Operating and Safety Rules govern movement, sports activities, and safe conduct on the premises of HUDY Boulder Karlín, particularly on the main bouldering wall, the children’s bouldering wall, the children’s play area, the landing areas, and in related sports facilities. These rules are binding for all visitors to the extent corresponding to their age and how they use the facility.

Risk Warning. Bouldering and other climbing activities are sports that involve the risk of falling and sustaining an injury, even when safety rules are followed. Visitors are required to acknowledge these inherent risks, comply with these rules, and follow the operator’s instructions. This does not affect the rights and obligations of either the operator or the visitor as set forth in applicable laws.

1. Definitions and General Rules

Operator: Boulder Area s.r.o., which operates the HUDY Boulder Karlín sports facility.
Service / Employee: a person authorized by the operator to perform operational duties, supervision, or other activities at a sports facility.
Visitor: Any person who enters the HUDY Boulder Karlín sports facility for the purpose of climbing, exercising, participating in a class, or engaging in another activity, or for the purpose of accompanying or supervising another person.
Climbing Wall: the main bouldering wall and related sports equipment, including a campus board, spray wall, and more.
Children’s climbing wall: a children’s bouldering wall, a children’s playground, and the areas immediately surrounding them.
Before using the sports facility for the first time, every visitor is required to read and comply with these operating and safety rules. Confirmation of having read the rules may be provided through the registration system and verification via an SMS code, or by another method specified by the operator.
Visitors are required to follow the operator’s staff instructions regarding safety, the organization of operations, the closure of parts of the sports facility, or the protection of others.
The operator is authorized to temporarily restrict access to or close part of the sports facility if necessary for safety, technical, operational, or organizational reasons.
Access to and use of the paid sports zone are permitted upon fulfillment of the operator’s registration and payment terms. Details are set forth in the current price list and separate terms and conditions of business and payment.

2. Safety While Climbing and Moving Around the Sports Facility

Before beginning any sports activity, every visitor is required to assess their current state of health, physical capabilities, and abilities in a manner appropriate to their age and experience. People with health conditions, pregnant women, or anyone for whom a sporting activity could pose an increased health risk should assess the suitability of the activity in advance based on their health condition and, if necessary, consult a doctor.
Visitors are not permitted to enter the climbing area or begin climbing if they are under the influence of alcohol, narcotics, psychotropic substances, or any other substances that impair their ability to move safely and exercise sound judgment.
Climbing is permitted only in designated areas and only with footwear that complies with the rules for that section of the facility. The main bouldering wall and the Campus Board may be used only above the designated landing area.
It is prohibited to enter, walk through, or remain in the area where a climber might land. Anyone who is not climbing must monitor the situation in the surrounding area and clear the landing zone.

Before beginning to climb, every climber is required to check whether a potential fall could endanger another person. If climbing routes or landing zones intersect, the climber is required to wait.
It is prohibited to leave backpacks, bottles, cell phones, toys, or other items in the landing area. Before climbing, visitors must also remove any items that could cause injury if dropped, particularly rings, loose jewelry, keys, or other hard objects.
Every visitor is required to behave considerately, not to endanger or unnecessarily restrict others, and to adapt their behavior to the current occupancy of the sports facility.
Visitors are required to report any technical defect they discover—particularly a loose or damaged hold, or damage to the structure or landing area—to an operator’s employee without undue delay. Until the defect is repaired or marked, the visitor must not use that area and must alert people in the immediate vicinity to the identified hazard in an appropriate manner.
The operator recommends that beginners and anyone who is unsure about how to use the facility safely take a training session or seek the services of a qualified instructor.

3. Injuries and Emergencies

In the event of an accident or an immediate threat to health, every visitor is required to provide reasonable assistance to the best of their ability, without endangering themselves or others, and to immediately notify the operator’s staff.
If the injured person’s condition requires it, call the emergency medical services at 155 or, if necessary, the integrated emergency response system at 112.
The operator has basic first-aid supplies available on the sports facility premises. An employee of the operator will document the reported injury to the extent appropriate to the nature of the incident and in accordance with the operator’s internal rules. The individuals involved are required to cooperate reasonably to clarify the circumstances of the incident.

4. Minors

The basic rule.
For safety reasons, the operator distinguishes between individuals under the age of 15 and those who are at least 15 but under 18 years of age. This age limit is an operational and safety rule of the sports facility.

Persons under the age of 15.
A person under the age of 15 may participate in sports activities on the climbing wall or the children’s climbing wall only under the direct supervision of their legal guardian or another person at least 18 years of age whom the legal guardian has authorized to supervise the minor or whose supervision the legal guardian has approved. The adult providing supervision is required to ensure that the minor complies with these rules and to exercise appropriate supervision over the minor at all times during the minor’s sporting activity.

Direct supervision.
Direct supervision means the presence and attention of an adult supervisor such that the supervisor has the minor under control in a manner appropriate to the minor’s age, experience, and situation, can monitor the minor’s movements, and can intervene immediately if necessary. The supervising person must not simultaneously engage in any activity that would prevent him or her from exercising effective supervision.

Confirmation from a legal guardian.
Before a person under the age of 15 uses the sports facility, the legal guardian’s consent to the use of the facility and to the supervision conditions must be recorded in the manner specified by the operator. Confirmation may be provided through the registration system with SMS code verification and, if required by the current registration procedure, also in writing at the front desk. If supervision is provided by an adult other than the legal guardian, that person confirms that they assume the responsibility for providing adequate supervision for the duration of the child’s visit.

People aged 15 to 18.
A person who is at least 15 years of age but under 18 years of age may engage in sports activities on the climbing wall independently only if the operator has received prior consent from the person’s legal guardian for the independent use of the sports facility. Consent must be recorded in the manner specified by the operator, specifically in writing or through a registration system verified by an SMS code. At the same time, the minor is required to personally confirm that they have read and will comply with the operating rules.

No entry without permission.
If a person between the ages of 15 and 18 does not have valid consent from a legal guardian to use the sports facility independently, that person may engage in sports activities only under the direct supervision of a legal guardian or another person 18 years of age or older authorized by the legal guardian, just as a person under the age of 15 would.

Responsibility.
Neither the consent of a legal guardian nor the assumption of supervision by another adult constitutes a transfer or exclusion of the operator’s legal liability. Each person’s liability for any harm or damage is assessed based on the specific circumstances and applicable laws.

Age and Identity Verification.
The operator or an employee authorized by the operator may, in justified cases, request proof of age or identity by presenting an identity document or other photo ID. The document serves to verify the information; the operator does not make a copy of it unless there is a separate legal basis for doing so.

Supervision on the children’s climbing wall.
A legal guardian or other supervising adult is permitted to enter the children’s climbing wall area while supervising a child, to the extent specified by the operator, without paying a separate admission fee, provided that the guardian or adult is not using any paid sports services.

5. Courses, Organized Groups, and Instructors

The course leader, coach, instructor, or any other person organizing a group sports activity is required to notify the operator’s staff before the activity begins, unless the organization of the activity has been arranged in advance in some other way.
The person leading a course or an organized group is responsible for the proper management of the group, adequate supervision of the participants, and compliance with these operating rules and the operator’s instructions within the scope of their activities. This does not affect the operator’s liability for obligations imposed on it by law.
For safety reasons, one adult supervisor may be responsible for no more than 6 preschool-aged children or 10 children between the ages of 6 and 15 during an organized activity, unless the operator sets a stricter limit for a specific event.
Courses and instructional or coaching activities provided as a service to third parties at a sports facility may only be conducted by a person 18 years of age or older who meets the operator’s qualification and contractual requirements and has the operator’s consent to perform such activities.
Engaging in any other business or profit-making activity on the sports facility’s premises is permitted only with the operator’s prior consent.

6. Order, Alcohol, Smoking, and Other Restrictions

Visitors are required to keep all areas of the sports facility clean and orderly and to comply with fire safety regulations and the instructions set forth in the fire alarm guidelines or on the evacuation signs.
Smoking and the use of narcotic or psychotropic substances are prohibited on the climbing wall premises. Alcohol may be consumed only in the designated area. After consuming alcohol, visitors are not permitted to climb or engage in any other sporting activity where the effects of alcohol could endanger their own safety or the safety of others.
Dogs and other animals are not permitted in sports facilities, unless otherwise specified by law or by the operator in a specific case.
Visitors are required to use the facilities and equipment only in a manner consistent with their intended use and the operator’s instructions.

7. Rented Equipment and Compensation for Damages

Visitors are required to handle the rented equipment with care and return it in a condition consistent with normal use.
In the event of loss or damage to rented equipment, the visitor is liable for the resulting damage to the extent specified by law. When determining the amount of compensation, particular consideration is given to the nature of the damage, the actual value of the item, and its wear and tear.
Each visitor is liable for any damage caused by a breach of a legal obligation or these operating rules, to the extent provided by law.

8. Denial of Entry and Removal from the Sports Facility

The operator or an employee authorized by the operator may deny entry to or remove from the sports facility any person who violates these operating rules or safety instructions, endangers themselves or others, intentionally damages property, disrupts operations, or is clearly under the influence of alcohol or other intoxicating substances.
If the violation is minor and circumstances permit, the visitor may first be asked to correct the situation. In the event of a serious safety risk or repeated violations of the rules, the visitor may be expelled without prior warning.
If a visitor is expelled as a result of a serious or repeated violation of the rules, the visitor is not entitled to a refund for admission that has already been used or is currently in progress, unless otherwise provided by law.
In justified cases, the operator may refuse further entry to a person who has seriously or repeatedly violated the sports facility’s rules. Such a measure must be proportionate to the nature and severity of the previous conduct.

9. Surveillance System and Personal Data

Selected areas of the sports facility may be monitored by a camera system during operating hours, primarily to protect the life and health of individuals, protect property, prevent security incidents, and investigate them.
Detailed information about the data controller, the legal basis for processing, the scope of the camera system, the retention period for recordings, and the rights of data subjects is provided in a separate privacy notice available on the operator’s website and at the sports facility.
The operator processes personal data collected during registration, the recording of legal guardians’ consent, and the handling of accidents or operational incidents only to the extent and for the duration necessary to fulfill the relevant purpose and in accordance with applicable laws.
Confirmation that you have read these operating rules, or a legal guardian’s consent to the use of the sports facility, does not in and of itself constitute consent to receive marketing communications. The sending of marketing communications is governed by separate legal terms and conditions.

10. Final Provisions

These Operating and Safety Rules take effect on the date of their publication by the operator.

The terms and conditions of sale, payment, and returns are governed by the separate Terms and Conditions of Sale and Payment of HUDY Boulder Karlín. In the event of any conflict between these operating rules and the terms and conditions of sale, the terms and conditions of sale and payment shall apply to matters concerning payments, credit, returns, and consumer rights.

The operator is authorized to amend these operating rules as appropriate, particularly for safety, technical, organizational, or legal reasons. The current version is published on the operator’s website and available at the sports facility. Amendments do not have retroactive effect on rights and obligations that have already arisen, unless the immediate application of a new safety rule is necessary to protect life, health, or property.
These operating and safety rules take effect on the date of their publication by the operator.
